TERMS AND CONDITIONS

 

All orders for goods accepted by Hizen-ya are accepted subject to the following conditions which shall form part and govern the contract of sale. Acceptance of goods shall be deemed to be acceptance of these conditions of sale.

 

Product Availability

We aim to keep all the goods on our website in stock but we can only carry limited stocks of certain items due to their unique, hand-made nature. We aim to remove out of stock items from the website immediately but, in the event of an ordered item being out of stock, despite our best efforts, we will contact you as soon as possible to arrange a replacement or to advise how long it will take us to obtain another identical or similar item.

 

Customer Location

We currently accept orders from within the UK and the countries in the European Union and countries shown on the dropdown list. If your country is not one of these please feel free to contact us for consideration by email. Please note it is the responsibility of non-EU customers to pay customs and import duties in their own countries.

 

Methods of payment - Credit/Debit Card

We accept most major credit/ debit cards. All prices shown on the Hizen-ya website are in sterling (GBP) and include VAT at the appropriate rate. Children's clothes and Tea are exempt of VAT.

 

Credit Card Security

Hizen-ya take online security very seriously. All our on-line payments are processed by Protx. When you place your order you will be directed to Protx secure server. This means all your transactions are encrypted and fully secure.

 

Order Confirmation

Once your credit card payment has been accepted, you will be sent an email acknowledging our acceptance of your order.

 

Delivery & Charges

We deliver throughout the UK, EU and other European countries. Most items will be delivered by Royal Mail, using either their First or Second Class or Parcel service. Items sent outside the UK will be sent by recorded delivery, so a signature will be required on receipt. We aim to dispatch all items during the next working day at the latest, orders placed before 2:00pm will usually be dispatched the same day. We reserve the right to use a courier service for larger orders within the UK, and in such conditions the customer will always be notified by e-mail of our decision to alter the delivery method.

 

Cancellation, Return & Exchange Policies

Cancellation is applicable only if we receive your notification before we dispatch your order. However, if the order has already been sent, cancellation is not possible anymore but you can still return the order. Returns & Refunds If you are not satisfied with your purchase, you may return the item within 7 days of delivery for a full credit/refund of the purchase price. To make a return, send us an e-mail with the following information before sending back the item/s.

1. Order reference

2. Product ID

3. Reason for return

 

If only part of a multiple item order is being returned only the cost of returned item/s will be refunded.

 

Faulty Goods

If you find that an item is faulty, please e-mail us at hizen-ya@hotmail.co.uk within 24 hours to arrange a refund or replacement. Returned faulty items will be refunded in full along with the original postage costs.

 

Refunds will be made via the original payment method within 30 days of our receipt of the faulty item. Our returns policy does not affect your statutory rights. If, in the unlikely event of your goods having been damaged in transit please do not sign for them until you have inspected them. If they have been damaged please retain the original delivery carton and mail us at hizen-ya@hotmail.co.uk within 24 hours to arrange a refund or replacement.

 

Under the Consumer Protection (Distance Selling) Regulations 2000

You have the right to cancel your order and receive a full refund with no financial penalty for any item or services. Certain exemptions apply: Computer Software where the protective seal has been broken and perishable items such as fresh flowers. You may cancel your order by sending or delivering to us a, fax or e-mail cancellation letter at any time up to and including seven days (excluding Saturdays, Sundays and Public Holidays) after the day on which you receive your purchase. For the purpose of cancellation our contact details are provided above. If you exercise your Statutory Right to Cancel your order, you must return to us at your expense the item or items that you wish to return.

 

Returning Goods

In the event that goods need to be returned to us, we strongly advise that an insured delivery method such as Recorded Delivery or Royal Mail Special Delivery is used. Hizen-ya will accept no responsibility for returned items until they are on company premises. Returned Goods. Not covered by Distance Selling Regulations (a) The vendor will not accept goods for credit or refund unless such return has been authorized by Hizen-ya, and the goods are received by Hizen-ya in stock condition, with original packaging. (b) The purchaser shall unless otherwise stated, or goods are being returned under the Distance Selling Regulations be responsible for the cost of outward and return carriage and insurance of all goods returned by the purchaser to Hizen-ya for refund or credit which goods shall be at the risk of the purchaser until actual receipt of the goods by Hizen-ya. The onus of proof of safe delivery shall rest with the purchaser. (c) Hizen-ya shall refund postal expenses on returns of faulty or incorrectly supplied goods. (d) No credit or refund shall be made for goods until they have been received complete. Refunds Full refunds will be in the form of the original method of payment. In the case of partial refunds, if a refund by the original method of payment is not possible it may be necessary to make this in the form of a UK cheque.

Complaints policy

There may be occasions when you are unhappy with the service that we provided to you. In these cases, we will endeavour to be fair and efficient in handling any complaint and to process your complaint confidentially. If you have a complaint, please send us a letter to Hizen-ya's trading address or E-mail us. We will endeavour to give you an answer within 3 working days and will provide you with a likely timescale for resolving the dispute. We will keep you informed about the progress of your complaint. Please note your statutory rights are not affected by these terms and conditions.

 

Limitation of Liability Disclaimer.

You agree that your use of this site is at your sole risk and acknowledge that the Service and anything contained therein, including, but not limited to, content, services, goods or advertisements (the "Items") are provided "AS IS" and that Hizen-ya makes no warranty of any kind, express or implied, as to the Items, including, but not limited to, merchantability, non-infringement, title or fitness for a particular purpose or use. Hizen-ya does not warrant that the Service is compatible with your equipment or that the Service is free of errors or viruses, worms or "Trojan horses" and is not liable for any damage you may suffer as a result of such destructive features. You agree that Hizen-ya, its Suppliers shall have no responsibility or liability for (I) any injury or damages, whether caused by the negligence of Hizen-ya, its employees, subcontractors, agents, Suppliers or otherwise arising in connection with the Site and shall not be liable for any lost profits, losses, punitive, incidental or consequential damages or any claim against Hizen-ya by any other party or (II) any fault, inaccuracy, omission, delay or any other failure in the Site caused by your computer equipment or arising from your use of the Service on such equipment. The content of other Web sites, services, goods or advertisements that may be linked to the Site is not maintained or controlled by Hizen-ya. Hizen-ya is therefore not responsible for the availability, content or accuracy of other Web sites, services or goods that may be linked to, or advertised on, the Site.
